User Content
5.1. By using the App, you may have the opportunity to submit or post user-generated content. 5.2. You retain ownership of any intellectual property rights that you hold in your user content. 5.3. However, by submitting or posting user content on the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your user content in connection with the App.
Prohibited Conduct

You agree not to use the App for any unlawful purpose or in any way that could damage, disable, overburden, or impair the App or interfere with any other party's use and enjoyment of the App. 6.2. You also agree not to engage in any conduct that is harmful, offensive, or violates any applicable laws or regulations. 6.3. Prohibited conduct includes, but is not limited to: a) Uploading, transmitting, or distributing any content that is unlawful, harmful, defamatory, or infringing on the rights of others; b) Accessing or attempting to access unauthorized areas of the App; c) Interfering with or disrupting the App's functionality or servers; d) Engaging in any activity that could compromise the security of the App or user accounts.

Gallery
8.1 Parents/guardians ("Parents") of children using the App give their explicit consent to teachers or authorized school staff ("Teachers") to upload images of their children to the App's gallery. 8.2 The images uploaded to the App's gallery will be visible to other Parents whose children are in the same class or group within the App. 8.3 Parents understand and agree that all uploaded images will be stored on Hula Technology (“The Company's”) cloud server for a period not exceeding 120 days from the date of upload. 8.4 After the 120-day period, the company will delete the images from its servers, and they will no longer be accessible in the App's gallery. 8.5 Parents acknowledge and agree that while the company takes reasonable measures to secure the images stored in its cloud server, no security measures are 100% foolproof, and there is a risk of unauthorized access or disclosure. 8.6 Parents understand that the App's gallery may be accessed by other Parents and agree to use discretion and respect the privacy of all children depicted in the images. 8.7 Parents have the right to withdraw their consent for uploading and sharing images at any time. To exercise this right, Parents must notify the Teachers or the App administrator in writing. 8.8 The company and Teachers will provide their best efforts to promptly remove the images of any child for whom parental consent has been withdrawn but cannot guarantee the immediate removal of all instances of the images from the App's gallery. 8.9 The company and Teachers shall not be held liable for any unauthorized access, use, or disclosure of the images that occurs despite reasonable security measures. 8.10 Parents represent that they have the legal authority to provide consent on behalf of their child and any necessary permissions from other involved parties, such as co-parents or legal guardians.8.11 Parents understand that by providing consent, they release the company and Teachers from any liability associated with the uploading, sharing, and storage of images in the App's gallery, subject to the terms of this clause. 8.12 The company and Teachers will use the images solely for educational and communication purposes within the App and will not use or distribute the images for any other purpose without the written consent of each parent and Teacher. 8.13 This consent clause is subject to the overarching terms and conditions of the App
Disclaimer of Warranties
9.1. The App is provided on an "as-is" basis, without any warranties or representations, expressed or implied. 9.2. We do not guarantee that the App will be error-free or uninterrupted, or that any defects will be corrected. 9.3. You use the App at your own risk.
Limitation of Liability
10.1. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue arising out of or related to your use of App. 10.2. In no event shall our total liability exceed the amount paid by you, if any, for accessing or using the App.

You agree to indemnify and hold Hula Technology (Pty) Ltd harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these terms and conditions, or your violation of any rights of another party.

Any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Western Cape High Court, Keerom Street, Cape Town, South Africa.
